Egality Law LLP and Ramirez & Meyers File Civil Lawsuit Against BI Incorporated and Employees for Sexual Harassment, Civil Rights Violations, and other claims.
SACRAMENTO, CALIFORNIA —Egality Law LLP and Ramirez & Meyers announce the filing of a Complaint for Damages in the Superior Court of the State of California, County of Sacramento, on behalf of Plaintiff Silvia Reyna Mendoza, against BI Incorporated, a subsidiary of The GEO Group, Inc., and two of its employees, Luis Ruiz and Montserrat Esquivel, along with additional unnamed defendants.
The lawsuit alleges multiple causes of action, including violations of the Unruh Civil Rights Act (Civil Code §51), Sexual Harassment (Civil Code §51.9), Unfair Business Practices (Business & Professions Code §17200), and claims for Intentional and Negligent Infliction of Emotional Distress, Negligence, Negligent Supervision, and Negligent Hiring, Training, and Retention.
According to the complaint, Ms. Reyna Mendoza, an immigrant mother of eight who has lived in the United States for nearly four decades, was sexually harassed over a period of years by Luis Ruiz, an ISAP Case Specialist employed by BI Incorporated and responsible for monitoring her compliance under an ICE supervision program. The complaint further alleges that Mr. Ruiz engaged in “severe and pervasive sexual harassment,” including the sending of explicit photographs and videos and repeated requests for sexual favors.
The complaint also asserts that after Ms. Reyna Mendoza reported this conduct to another BI employee and her supervisor, Montserrat Esquivel, BI personnel engaged in a cover-up, allegedly taking Ms. Reyna Mendoza’s phone and deleting the incriminating messages and videos. Rather than taking corrective action, BI allegedly retaliated against Ms. Reyna Mendoza by increasing the intrusiveness of her monitoring—forcing her to wear an ankle monitor after years of compliance via phone app. She was also later detained by ICE.
The complaint asserts that BI Incorporated’s conduct violated California’s civil rights and other laws, and that the company’s failure to investigate or discipline its employees constitutes willful negligence and retaliation against a vulnerable immigrant woman seeking only to assert her rights and dignity. The lawsuit seeks compensatory and punitive damages, injunctive relief to prevent further unlawful business practices, and attorney’s fees.
